Legal Disputes

Land is a limited resource on this planet. Once allocated it is very difficult, if not impossible, to find new land. Land is split into areas which allow the owner access and exclude others without express permission and is done in the form of a legal boundary.

A boundary is essentially a conceptual entity and may appear in the form of a bank, a hedge, a wall or fence or even a discontinuation in the terrain. These 'features' make up a theoretical boundary that can be mapped, surveyed and documented in a legal manner.

In modern times, chartered surveyors will specify a legal boundary which is supported by accurate documentation and stored within land registry archive. However, for older properties, the boundary may not be correctly mapped or may not even be mapped at all. It is also the case that fences and hedgerows can be moved to alter a land boundary.

In these cases it can be very difficult to prove the original position of a boundary at a specific point in time. Historical aerial photography plays an important role in establishing this information in a definitive way. Being a photograph, it is a static record of time that can therefore be submitted as evidence in a court of law.
